On 2 October 2008, Deminor announced that it would launch a collective action for European investors who, advised by their banks, had invested in structured bonds issued by Lehman Brothers. These products were largely distributed on the European market the last several years by the intermediary of several financial institutions.
Based on its analysis, Deminor believes that the financial institutions did not inform their clients accordingly with regard to these Lehman Brothers products, and subsequently asks for compensation that matches the invested amount. In 2009, Deminor was the first in Belgium to bring Citibank Belgium S.A. and Deutsche Bank S.A. before the Brussels Chamber of Commerce, for more than 700 Belgian investors.
Concerning Citibank Belgium S.A., our collective action has lead to an overall settlement between the bank and our clients, as a result of which they were able to recover between 65% and 75% of their investment.
During the summer of 2009, Deminor has launched civil proceedings for damages against Deutsche Bank S.A. before the Brussels Chamber of Commerce. These proceedings are currently pending. Parallel to these civil proceedings launched by Deminor, the Brussels public prosecutor has, as in the Citibank file, launched a procedure against Deutsche Bank S.A. and its managers named "information". The objective of this procedure is to collect a maximum of information to determine if there might be some offenses on the side of the accused that could justify the referral of the case to a criminal court, which in turn shall have to judge the authenticity of the facts and the accuser's accountability.
Parallel to these legal proceedings against the aforementioned financial institutions, Deminor has simultaneously guarded the interests of its clients who are represented in the bankruptcy proceedings of Lehman Brothers in the United States and in The Netherlands.
